This Privacy Policy describes how your Personal Information (defined below) is collected, used, and shared by Red Rock Outdoors Co. d/b/a Redwood Outdoors (“Redwood Outdoors”) when you visit, access information or resources on, or make a purchase from our website at https://redwoodoutdoors.com, communicate with us by e-mail or other electronic methods, or interact with our official accounts on the third-party social media platforms linked in the footer of our website (collectively, the “Site”).  

Capitalized terms used but not defined in this Privacy Policy have the definitions provided in our Terms and Conditions, located at https://www.redwoodoutdoors.com/terms-of-service/ (“Terms”).

Certain jurisdictions require that we provide additional information regarding our privacy practices and your privacy rights You may be entitled to additional rights regarding your Personal Information in addition to the rights provided below if you are a resident of a U.S. state that has enacted consumer data privacy legislation which applies to Redwood Outdoors (including California, Colorado, Indiana, Iowa, Kentucky, Minnesota, New Jersey, Oregon, Tennessee, Utah, Virginia, Connecticut, Delaware, Maryland, Montana, New Hampshire, Rhode Island, and Nevada). 1. What is Personal Information? 

As used in this Privacy Policy, "Personal Information" means information that can be used to identify an individual, the processing of which is subject to applicable data privacy laws. The term “Personal Information” can include information such as your name and e-mail address, but can also include indirect identifiers such as your IP address or device identifier. The term “Personal Information” does not include aggregate information, which is data we collect about the use of the Services or categories of such users, unless it is linked with your other Personal Information.  

You acknowledge and agree that you, not Redwood Outdoors, are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and right to use of all information about you that you submit, and for ensuring that any information about you that you provide is kept up to date for the purposes for which you provide it. Inaccurate information may affect your ability to use the Site, the information you receive when using the Site, and our ability to contact you.  

2. What personal information do we collect about you?  
In general, we may process the following categories of Personal Information about you in connection with your access to or use of the Site: (A) “Device Information", which is Personal Information that we automatically collect, and (B) “Order Information”, which is Personal Information that you provide to us directly. For more information about how we collect and process each category, see the sections below. 

a. Device Information  

We use tools provided by Shopify, Google Analytics, and other third-party analytics service providers  to automatically collect certain information from your web browser, mobile, or other devices when you visit or otherwise use the Site, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically collected information as “Device Information”. 
 
We collect and process Device Information using tracking technologies, including the following technologies:  

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, visit http://www.allaboutcookies.org.  

  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.  

  • “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site. 

Both our Site and the third-party vendors providing services to us in connection with the Site use cookies for our marketing, sales and analytics purposes. We may also permit third parties and service providers to use cookies on our Site to better tailor the services, products and advertising on our Site and other websites. Such third-party vendors may also provide Device Information and other Personal Information to us as part of their services. For specific information about the cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies 

Depending on your device specifications and settings, you may be able to configure your browser to restrict, disable or block our tracking technologies, or to notify you whenever tracking technologies may be deployed so that you can decide each time whether to accept it. Note that refusing to permit the above tracking technologies may in some cases preclude you from using, or negatively affect the display or function of, a website or certain areas or features of a website. We will not be liable for any interruption in, or inability to use, the Site or our services or degraded functioning thereof, where such are caused by your settings and choices regarding cookies. 

Our use of online tracking technologies may be considered a “sale” or “sharing” under certain laws.  To the extent that disclosing information to these online tracking technologies is deemed to be a “sale” or “sharing” under certain laws, you can opt out of these online technologies by submitting a request using the process described in the “What are my rights under data privacy laws?” section below.  

b. Order Information 
We receive Personal Information when you make a purchase or attempt to make a purchase through the Site, sign up to receive services from the Site, send us messages in connection with the Site, or otherwise submit Personal Information for processing by the Site. Any Order Information that we receive about you is provided directly by you, or on your behalf, on a voluntary basis, and may include your name, billing address, shipping address, customer support information, payment information (including credit card numbers, e-mail address, and phone number). We refer to this information as “Order Information”. We may collect Order Information from you in the following circumstances: 

Some features of the Services may require you to directly provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. 

  • Use of the Site. You will be required to provide Personal Information to use or access certain tools and features of the Site. If you register for an account, you may be required to provide us with Personal Information such as your contact information, including your full name and e-mail address, as well as a username, password, security questions and other information used for account security purposes.   

  • Communications with Redwood Outdoors. When you sign up to receive e-mails from us, or send messages, opinions, feedback, or other correspondence to us, we may receive Personal Information about you, and may use the information that you provide to respond to your communication and/or as described in this Privacy Policy. We may also archive this information and/or use it for future communications with you where we are permitted by law to do so.   

Some Personal Information that you submit can be removed at any time upon your request. Note, however, that some Personal Information is necessary to use the Site. As such, even if you remove all Personal Information from your account, we may retain some of your Personal Information to comply with our legal obligations or as necessary to provide the Site and its related services to you. 
 
3. How do we use your Personal Information? 
Where permitted by applicable laws, we use your Personal Information (including Device Information and Order Information) to:  

  • Communicate with you; 

  • Screen our orders for potential risk or fraud;  

  • Provide you with information or advertising relating to our products or services.  

  • Personalize and develop our Site and the services we provide to you, and improve our offerings. 

  • Provide certain features or functionalities on the Site. 

  • Create, maintain, customize, and secure your account with us. 

  • Help maintain the safety, security, and integrity of our Site, services, databases, other technology assets, and business. 

  • Test, research, analyze, and develop products, both related and unrelated to our Site and services. 

  • Comply with our Terms of Service. 

  • Comply with any applicable laws and regulations and respond to lawful requests. 

  • Fulfill any other purposes disclosed to you at the time we collect your Personal Information and/or pursuant to your consent. 

In addition to the purposes described above, we use the Order Information that we collect generally to fulfill or otherwise meet the reason you provided the information (e.g., to fulfill any orders placed through the Site by processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations), and to provide you with support, to communicate with you and respond to your inquiries, including by investigating and addressing your concerns, and monitoring and improving our responses.  

We also use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).  
 
4. Does Redwood Outdoors share my Personal Information? 

We share your Personal Information with, and receive Personal Information from, third parties to help us to provide the Site and its related services to you, as well as for the other purposes specified in this Privacy Policy. For example, we use Shopify to power our online store. We also use Google Analytics for marketing purposes and to help us understand how our customers use the Site -- you can read more about how Google uses your Personal Information here: https://www.google.com/intl/en/policies/privacy/. We may also share Personal Information with other third parties to enhance your shopping experience. For example, we may enable Shopify to match your account with other Shopify services that you may choose to use. In this case, Shopify will process your information as set forth in its Privacy Policy and Consumer Privacy Policy. 
 
Further, we may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, to otherwise protect our rights, and/or otherwise in connection with our Terms and other agreements. We reserve the right to disclose or transfer any information we have about you as part of, or during negotiations of, any merger, sale of company assets, or acquisition, or in any other situation where Personal Information may be transferred with other assets of Redwood Outdoors.   

While we do not disclose information to third parties in exchange for monetary compensation, we disclose identifiers and Internet and network activity information to third party advertising networks and analytics providers for purposes of marketing and advertising, and to improve and measure our ad campaigns.  Such disclosures may be considered “sale” or “sharing” of Personal Information under applicable laws.  We do not sell or share sensitive information, nor do we sell or share information about individuals we know are under the age of sixteen (16). 5. Do you use my Personal Information for marketing purposes? 

When you create an account with us or otherwise provide us with your e-mail address, we may send you Site-related notices, as well as updates, news, and marketing messages relating to our products and services. Additionally, as described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. 6. How do I opt out of the use of my Personal Information for marketing purposes?

Our marketing e-mails will include an unsubscribe link and other instructions allowing you to opt out of receiving future e-mails or to change your contact preferences. Additionally, if you have an account with us, you can change your contact preferences by updating your contact information within your account settings. Please note that even if you opt out of receiving e-mails from Redwood Outdoors, you may still receive relationship e-mails from us, including responses to e-mails that you send to us, notices of updates or changes to our policies and procedures, or other messages relating to your account or your use of the Services.

Some web browsers incorporate a “Do Not Track” (“DNT”) or similar feature that signals to websites that a user does not want to have the user’s online activity and behavior tracked. If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain information about that browser’s user.  

We honor Global Privacy Control as a valid request to opt-out of the sharing of information linked to your browser or the device that you use to access our Site. Please be aware, however, that opt-out preference tools are limited to the browser or device you are using. Further, your browser may save some information in its cookies and cache to maintain your privacy preferences, and if you clear cookies, you may remove your opt-out preferences and be required to opt out again. To learn more about Global Privacy Control, you can visit https://globalprivacycontrol.org/. Other than the Global Privacy Control, we do not recognize other “Do Not Track” signals that may be sent from your web browser or device. 

7. What are my rights under data privacy laws? 

As of the “Last Updated” date indicated on this page, Redwood Outdoors is not subject to the data privacy laws of the European Union or the United Kingdom. If you are located outside of the United States, note that all information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live.  

If you are located in Colorado, Indiana, Iowa, Kentucky, Minnesota, New Jersey, Oregon, Tennessee, Utah, Virginia, Connecticut, Delaware, Maryland, Montana, New Hampshire, or Rhode Island, you may have certain privacy rights under the law of your jurisdiction. This section describes the rights provided to users who qualify as “consumers” under the data privacy laws of those states (collectively, “State Privacy Laws), and explains how you can contact us to exercise those rights. 

Under applicable State Privacy Laws, you may have the right to know what Personal Information we have collected about, to request that we provide access, correct, or delete your Personal Information, that your Personal Information be provided in portable form, and non-discrimination for your exercise of any of the rights provided to you under law.

A. Privacy Rights in California 

Under the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA”), you have rights to request access to specific information, data portability and deletion, as described below. These rights are not absolute, and in some instances, we may decline your request as permitted by law. Redwood Outdoors may ‘share’ your Personal Information with third parties for purposes of targeted advertising. For information about exercising your right to opt out of the sale or sharing of Personal Information under the CCPA, please refer to the section “Exercising Data Subject Rights” below. 

1. Access to Specific Information and Data Portability. You can request the following information about how we have collected and used your Personal Information during the past 12 months:

In addition to the rights above, you have the right to exercise your rights free from discrimination prohibited by the CCPA. Examples of discriminatory actions that we are not permitted to take under State Privacy Laws in response to a consumer’s lawful exercise of their rights regarding their Personal Information include: 

  • Denying you goods or services. 

  • Imposing additional charges on you for services or imposing penalties. 

  • Providing you with a different level or quality of goods or services. 

  • Suggesting that you may receive a different price or rate for goods or services or a different level or quality of goods or services. 

  • Otherwise retaliating against you, if you are our employee or independent contractor, or if you have applied to work for us. 

B. “Sale” and “Sharing” of Information About You 

State Privacy Laws require that we notify you if we use your Personal Information for “targeted advertising”; this includes the CCPA, which requires that we provide transparency about Personal Information we “sell” or “share.” As used herein, and for purposes of the CCPA, “sale” means a transaction in which we disclose Personal Information of a California resident to third parties in exchange for valuable consideration. “Targeted advertising” or “sharing” means selecting advertisements based on Personal Information obtained from activities of a consumer subject to State Privacy Laws across unaffiliated websites to display certain advertisements to that consumer.  

In the twelve months preceding the date on which this Privacy Policy was last revised, we have “sold” or “shared” information about you for cross-context behavioral advertising purposes as shown below. C. Exercising Data Subject Rights 

Residents of California, Virginia, Colorado, and Texas are entitled to request to exercise their rights as a consumer or a data subject up to twice in a 12-month period, while residents of the remaining states with State Privacy Laws are entitled to exercise such rights once every 12-month period. We may charge a reasonable fee for excess requests in the same 12-month period, as permitted by applicable law. 

To exercise the rights available to you as a data subject under applicable laws, you may submit a verifiable consumer request to us by using the contact information provided at the bottom of this page. 

Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. Your verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative, and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with information if we cannot verify your identity or authority to make the request. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. 

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

8. How does Redwood Outdoors secure my Personal Information? 

We use certain physical, managerial, and technical safeguards designed to secure Personal Information that we process in connection with your use of the Site. For example, we encrypt all data with secure sockets layer (SSL) or similar technologies when we transmit your Personal Information. This, however, does not guarantee that your Personal Information may not be accessed, disclosed, altered, or destroyed by any breach of our physical, technical or managerial safeguards. In the event that any of your Personal Information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and will notify you, as appropriate, in accordance with pertinent laws and regulations. 
 
9. Does Redwood Outdoors retain my Personal Information? 
When you place an order through the Site, we will maintain your Personal Information for our records unless and until you ask us to delete this information. Note that we will retain your Personal Information for as long as needed to provide you with our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements, as permitted by applicable laws. 
 
10. How will I know about updates to this Privacy Policy? 
We reserve the right to update this Privacy Policy from time to time in our sole discretion in order to reflect, for example (but without limitation), changes to our practices or for other operational, legal or regulatory reasons. Such changes will be effective upon notice to you – which we may provide by posting the updated Privacy Policy on the Site, sending an e-mail to your account e-mail, or by other reasonable means. You should periodically review this Privacy Policy to ensure that you are familiar with the most current version. Your continued use of the Site after the “Last Updated” date posted above will constitute your acceptance of the updated Privacy Policy.
